Manitoba law forbidding politicians from crossing floor in the legislature will not be declared unconstitutional…yet!

Independent MLA Steven Fletcher who was kicked out of the Tory caucus in June will have to wait a few months more before a Manitoba Judge will hear a legal challenge Fletcher brought before the court.

Fletcher has asked the Court of Queen’s Bench to declare a law forbidding ousted members of a political party to cross the floor and join another party in the legislature unconstitutional.

Justice David Kroft has said that this matter deserves a full hearing and a decision will not be made prior to the resumption of the legislature later this month.

Under the law once elected you are not allowed to leave one party and join another unless you resign as an MLA sparking a by-election. The only other option is to sit as an independent and wait for the next general election.

Fletcher believes that the law introduced by the NDP in 2006 in unconstitutional and is a violation of freedom of expression and association.

The governing Tories have hinted that they intend to abolish the law at some point this fall.
