Judge says over 6 months too long to wait to appear in traffic court –

Provincial Court Judge Mary Kate Harvie has written a decision in a photo radar case of a woman accused of speeding in the fall of 2014.

The case took 18 months to come to trial and over a year for the Crown Prosecutors office to disclose documents to the defence.

Judge Harvie said "An accused is entitled to raise a defence to the charge and has the right to do so within a reasonable period of time.“

In a precedent setting decision Judge Harvie stated that 4 to 6 months would be considered reasonable to have a case like this heard in court.
