Manitoba Court of Queen’s Bench to review growth fees

 

 

 

 

 

The battle lines are set in the developers vs city of Winnipeg growth fee war.

As promised the Manitoba Home Builders Association and the Urban Development Institute are challenging the city’s news growth fees set to come into force on May 1, 2017 in court.

The two organizations have filed an application to have the Manitoba Court of Queen’s Bench review the new fees.

At the heart of the issue is wether or not the city has the legal right to implement growth fees under their charter. 

The city says that the city charter allows council to enact whatever fees it wants to including growth fees. The developers argue that the city has over stepped its authority and does not have the legal authority to impose growth fees.

 

 

The parties will gather for the first court date on February 21, 2017 but it is expected to take months before a ruling is made on the issue.
