COURT | CROWN TO APPEAL DECISION ON TRAFFIC TICKET

The crown prosecuters office will be appealing a decision by Provincial Court Judge Mary Kate Harvie.

In May Judge Harvie dismissed the charges against a woman who had received a photo radar ticket citing delays in getting to trial were excessive.

The woman had to wait 18 months from the time she received the ticket to have her case heard.

Harvie stated in her decision that 18 months was too long to wait and she felt a more reasonable time frame was four to six months. Harvie also belived the woman’s Charter rights had been violated.

Judge Harvie’s decision was considered precedent-setting.

Many Manitobans who have also been waiting more than a year to have their case heard are waiting on the outcome of the appeal and are hoping that their tickets also get dismissed due to excessive delay.
