Brandon Man’s Injury Claim Dismissed After IIU Investigation

An investigation by the Independent Investigation Unit of Manitoba (IIU) into a Brandon Police Service (BPS) arrest has concluded, with the IIU determining that the man involved did not sustain serious injuries as initially reported.

The incident, which occurred on January 9th at approximately 1:13 p.m., involved BPS officers executing an order under the Mental Health Act at a residence on the 1400 block of Applewood Bay in Brandon. According to the initial report from BPS to the IIU on February 20th, officers observed the male subject holding two large objects as they approached the door. When informed of their intent to take him into custody, the man retreated into the residence, leading to a confrontation in the living room.

A struggle ensued, resulting in a use-of-force incident. Following the arrest, the man, who was handcuffed and placed in a police cruiser, complained of rib pain and claimed they were broken. He was subsequently transported to Brandon Regional Health Centre for X-rays.

Due to the initial report of serious injuries during the arrest, the IIU assumed responsibility for the investigation, as mandated by Sec. 66(4) of the Police Services Act. The civilian director initially deferred designating any officers as subject officers, pending further investigation.

However, after interviewing the affected male, the IIU determined that he did not suffer broken ribs, contradicting his initial claims. Consequently, the IIU concluded that the incident did not meet the definition of a serious injury as outlined in their regulations (99/15).

“Given the evidence does not demonstrate the affected person suffered a serious injury defined by the IIU regulations (99/15) as a result of interaction with police, this incident no longer meets the IIU’s mandate,” stated the IIU in their release.

The IIU has closed the investigation, finding no further need for their involvement.
