New rules for companies delivering liquor and cannabis

The Manitoba government introduced legislation that would amend the Liquor, Gaming and Cannabis Control Act to ensure delivery companies do not deliver regulated products like liquor and cannabis to under age or intoxicated people.

“With continued growth in the delivery industry, particularly during the ongoing COVID-19 pandemic, we want to make sure that liquor and cannabis products are delivered safely and responsibly,” said Justice Minister Cliff Cullen.

The proposed amendments would shift liability for safe service and delivery to the delivery companies making deliveries of regulated products. Currently that liability rests with the restaurant, lounge or retailer with the initial licence.

The amendment would also permit the Liquor, Gaming and Cannabis Authority of Manitoba (LGCA) to hire minors and young people as part of its enforcement activities. These “minor agents” would then attempt to regulated products so that LGCA could monitor compliance on under-age sales.
