IIU says no charges will be laid against WPS officers

Two Winnipeg Police officers who were the centre of an investigation by Manitoba’s police watchdog agency will not be charged.

The Independent Investigation Unit (IIU) says that they began an investigation into two members of the Winnipeg Police Service in October 2016 after learning that a suspect’s arm had been fractured allegedly during an arrest by the officers on February 7, 2016.

The IIU says police were called to a restaurant in Winnipeg’s west end after a man refused to leave. He was arrested then released. The male then began recording police with his cell phone, a scuffle occurred and the man’s left arm was twisted and injured.

The male complained to the Winnipeg Police Professional Standards Unit who launched an internal investigation. The IIU was informed of the investigation and monitored it.

The IIU took over the case when the WPS told them that the man’s arm had been fractured as they are mandated to do when an injury is considered serious.

The IIU reviewed the male’s cell phone recording and interviewed civilian and police witnesses as well as reviewed medical records.

Upon completion of the investigation, the IIU sent the file to Manitoba Prosecution Service for review and were advised that the charging standard was not met and there was no reasonable likelihood either officer would be convicted of a criminal offence.
